Sean was 55 when he died, leaving behind his partner Clare and two children

Sean hadn't got around to making a new Will, neither had he divorced his first wife, who made a successful claim on his estate. This isn't what he would've wanted as he worked long hours in his own business to provide for his family. Perhaps he'd always intended to make a Will, or perhaps, like many, he didn't want to face his own mortality.

 

Case study 2

Paul and Lisa had two children. Sadly, the couple got divorced and Paul remarried a divorcee, Emily, who also had two children. Paul and Emily had a child together and five of them lived together in the same house until the children grew up and left home. Fast forward 30 years: Paul died; his Will made provision for his wife and the children of his second marriage but not the children of his first marriage, who, although they had always got on well with Paul's other children, felt a bitterness that never healed. Susie knew about lasting powers of attorney but had mentally put it off until she was older, thinking it was something older people need

Susie loved horses. She owned her own horse, which was liveried at a nearby stable. This meant she could ride most days. One day, she was riding on a quiet country lane when a car drove past at speed spooking the horse. Susie was badly injured and in hospital for six months, unable to make decisions about her health or her finances. Like most people, Susie knew about lasting powers of attorney but had mentally put it off until she was older, thinking it was something older people need. They do, of course but accidents can happen to anyone at any time, just as anyone can lose capacity either partially or completely then they need people they can trust to make important decisions on their behalf. Lasting powers of attorney, once in place, can be used the moment they're needed.
