TERMS OF BUSINESS – THE LAW GROUP LIMITED

The following standard terms of business apply to all instructions accepted by the Company. The Law Group Limited is a limited company incorporated in England and Wales with registered number 1239000 having its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ. The company is a member of the Society of Will writers.

All work carried in the provision of Legal Services are subject to these terms except where changes are expressly agreed in writing. These terms of business form the basis of the contract between the Company and the Client.

Our terms of business are set out below. Please read them carefully and ask us if there is anything in them which you do not understand. Your continuing instructions will amount to your acceptance of these terms and conditions of business. Unless otherwise agreed, these terms of business apply to any future instructions you give us. We reserve the right to update these terms from time to time and will notify you if we do so.

THE SERVICES TO BE PROVIDED

  1. SCOPE OF WORK
    1. The scope of our work will be as set out in the relevant letter sent to you by us or as we may otherwise have agreed with you in writing.
    2. Unless we agree otherwise in writing, our responsibilities do not include:
      • verifying the identities of other parties to transactions
      • advising you as to the commercial implications of any matter or transaction with which you are involved.
  2. PERSONNEL
    1. The individuals carrying out work on your behalf will include:
      • consultants
      • solicitors
      • STEP qualified staff
    2. However, it is the company The Law Group Limited as a whole (“the company”), rather than any specific individual, which is responsible for providing our services to you. We aim to avoid changing the individuals handling your work but if this cannot be avoided we will notify you as soon as possible.
  3. YOUR RESPONSIBILITIES
    1. We rely on you to provide us promptly with all the information we need to carry out your instructions and to let us know of any significant changes in your circumstances. You should also provide us with any relevant documents and respond to our requests for further information as fully and quickly as you can.
    2. When acting for you in relation to transactional matters, it is your responsibility to ensure that where appropriate we receive the full amount required to complete your purchase in cleared funds no later than the day of completion. We accept no liability for any loss or damage incurred as a result of banking difficulties or delays.
    3. Providing us with all necessary information to enable us to comply with the Money Laundering Regulations.
  4. CHARGES, INVOICING AND PAYMENT
    1. Our charges for professional services consist of our legal fees.

    2. Unless otherwise agreed, our charges are based on fixed fees . Where we are not able to agree a fixed fee, we will aim to provide you with the best information possible about likely costs.
  5. INVOICING AND PAYMENT OF INVOICES
    1. To enable you to budget we may send our invoices from time to time before the conclusion of your matter. We may deliver our invoices to you electronically . Please let us know if you have any particular requirements for the delivery of our invoices. It is our standard practice to seek half of the payment on account of our legal fees before starting work, and the remaining to be paid on completion. Currently we accept payment by bank transfer or cheques made payable to ‘The Law Group Limited’. We cannot accept any payment in cash above £25 in respect of our fees or for any other purpose.
  6. MANAGEMENT AND PROTECTION OF INFORMATION
    1. Cybercrime and email related fraud are on the increase. To protect you, your money and our business , the following security measures apply to the transfer to and from the company.
    2. We will only provide you with our bank account details in a PDF document which will be sent by mail or as an attachment to email correspondence. Prior to transferring funds to our account, we ask that you contact us to verify our account details. Please speak to your normal consultant here, if failing that, to someone in our team.
    3. We will only send you business -related emails from the @thelawgrouplimited domain address. Our website will only be www.thelawgrouplimited.co.uk . If you receive an email from an email address which does not match the above or are directed to a website that does not match the above URL please contact us immediately. Please beware of emails,purporting to be the company , where there is an unexplained change in the language, poor spelling or incorrect grammar.
    4. We accept no liability for any loss occasioned by the use of email.
    5. The company can provide secure methods for exchanging large files. However, if you request that we access documents from or upload documents to your account on a file sharing or cloud website, you acknowledge and accept that such service may not be secure and that you bear all risks and responsibilities arising from the use of that service.
  7. DISTANCE SELLING AND CANCELLATION OF CONTRACTS
    1. Under The Consumer Contracts ( Information, Cancellation and Additional Charges) Regulations 2013, where you are an individual not acting for your trade , business, craft or profession and where this deemed to be a distance contract, you may have the right to withdraw without charge within 14 days of when the contract is entered into. If you so cancel within that period we will promptly reimburse to you all payments received from you, unless you gave us your consent to start work within that period, in which case you will have to pay for the work done up to the date of cancellation.
  8. DATA PROTECTION
    1. The storage and use of personal details that we hold about you, or individuals that you represent (if any) is governed by the General Data Protection Regulation (EU) 2016/679) (GDPR) is effective in the UK) and any new UK data protection legislation. By instructing us to provide services to you, we and our carefully chosen suppliers, consultants will use these details solely to provide you with our services, to comply with our reporting and client verification obligations and to monitor, develop and improve our services including the IT systems used in relation to the provision of such services.
    2. The advice we give is confidential and for your exclusive use. We do not accept responsibility to any third party who is not our client for the advice we give to you.
  9. OUR SERVICE TO YOU
    1. We will exercise due skill, care and diligence in carrying out your instructions. In performing our services, we shall use reasonable care to:
      • Represent your interests and keep your business confidential.
      • Explain to you the legal work which may be required and the prospects of a successful outcome.
      • Inform you regularly of progress or, if there is none, let you know when you are likely to hear from us.
      • Deal promptly with your queries.
