Foresight is, of course, better than hindsight. Susie and Peter had two children, aged 12 and 14, when, sadly, Susie became terminally ill. It was something neither of them had planned for and there came a point when Susie was unable to make health or financial decisions for herself. This left Peter powerless to access money from her account on her behalf and unable to make crucial decisions regarding her treatment. The last few months of her life were fraught with practical problems, as well as emotional ones, for the whole family

It was a few years before Peter could bring himself to begin dating, but, eventually, after many dates and disappointments, he met Vanessa and the two of them got on well. Vanessa was divorced and had a young child. Peter and Vanessa got married and had a child of their own. Forty years later, Peter died. He had a Will that left everything to Vanessa. The children from the first marriage got nothing. This is called sideways disinheritance and is quite common. It can cause bitterness and irreparable family rifts.

With foresight, when Susie and Peter got married, they would have made sure their affairs were in order and looked at all their options. A consultant from The Law Group Limited would have explained to them they could own their property in two different ways: as joint tenants, which is how most couples own property, or as tenants in common. The latter would have given them more flexibility. It would have enabled them to set up a trust Will, ensuring that half the house would be held on trust for the children on the death of one of the parents. They should also have put lasting powers of attorney in place, which sees trusted family members and/or friends nominated to make decisions on financial and/or health issues, should they have lost capacity for whatever reason.

WITH FORESIGHT, WHAT WOULD YOU DO?

If you have assets, you could put your house into a lifetime trust to protect it against all eventualities and, in the event of death, make probate easier. This isn't suitable for everyone, but The Law Group Limited can guide you on this. Why wouldn't you want to protect what you have worked for all your life? The team at The Law Group Limited have seen how easily circumstances can change.
